This SWAG Creator Content Guidelines (“Content Guidelines”) shall apply to an individual who is desirous to register or has registered as a Swag Content Creator on the Watcho platform of Dish Infra Services Private Limited for the purpose of uploading content to the Watcho platform.
Acceptance and adherence to this Content Guidelines is mandatory for all SWAG Content Creators before they upload their content on the Watcho Platform. Dish Infra shall have the right to refuse registration, restrict upload of content, suspend or disable your account that is in violation of the Content Guidelines or any other applicable laws or if we determine that doing so is reasonably necessary to avoid or mitigate misuse of our platform /services, or to avoid adverse legal or regulatory impacts on Dish Infra Services Private Limited.
1. Adherence To Legal RegulationsCompliance with IT Rules 2021: Ensure your content adheres to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. This includes avoiding content that promotes or incites violence, hatred, or discrimination. Content creators must ensure Compliance of Code of Ethics prescribed under the Appendix of Part III of The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (provide link).This includes adhering to all provisions, including the general provisions outlined in II(A) of the Appendix:
(a) To not create any content which is prohibited under any law;
(b) Exercise due caution and discretion in the -
i. content which affects the sovereignty and integrity of India;
ii. content which threatens, endangers or jeopardizes the security of the State;
iii. content which is detrimental to India'’'s friendly relations with foreign countries;
iv. content which is likely to incite violence or disturb the maintenance of public order.
(c) Consider India’s multi-racial and multi-religious context and exercise due caution and discretion when featuring the activities, beliefs, practices, or views of any racial or religious group.
Copyright Laws: Ensure all content, including music, images, and video clips, is original or properly licensed. Avoid infringing on intellectual property rights.
The Content must not contain third-party intellectual property. In the event any third-party music, photograph, audio-visual clippings, any other literary, cinematographic, musical, artistic or dramatic works are used as part of the Content, the necessary approvals/permissions or rights must be obtained from the owners of the said works before incorporating them into the Content.
Rights Management: Ensure that you have the appropriate rights for any third-party content included in your work and that these rights are properly managed and documented.
Compliance with Applicable Laws: Content creators to ensure compliance with all applicable laws including child labour laws and the guidelines set by National Commission for Protection of Child Rights (NCPCR). Proper permissions/No Objection Certificate (NOC) must be obtained from the guardians/parents of the child featured in the content. Content creators must ensure compliance with the Flag Code of India and the Emblems and Names (Prevention and Improper Use) Act, 1950 whenever the Content includes the use of flags, emblems, insignia, or other symbols specified in these acts.
Cultural Sensitivity: Avoid content that may be deemed disrespectful or offensive to Indian culture, traditions, and religious sentiments.
a. Content should not incorporate any dialogues/ visual/gestures that harm/hurt religious sentiments of any particular caste, community, religion, race or tribe.
Content should not incorporate any dialogue/visuals/gestures that derogate/defame any national or religious icons/key controversial figures.
The Content creators must exercise due caution if the content contain references to real events/incidents and/or real life personalities. The Content must not illegally impersonate, defame, bully, harass, be obscene or stalk others. It must be ensured that the Content respect the rights of others, including their right to privacy.
Avoid Hate Speech and Discrimination: Steer clear of content that promotes hate speech, racism, sexism, or discrimination against any group based on religion, caste, gender, or nationality.
Responsible Representation: Be cautious about how sensitive topics like mental health, sexual content, and substance abuse are depicted. Ensure they are handled with care and accuracy.
No alcohol and tobacco brands should be shown in the Content.
In the event any animals are being depicted in any content, prior permission must be obtained from the relevant animal welfare board before the animal is portrayed/trained for the content.
Content Rating: Clearly mark the content rating and include appropriate age warnings. Ensure the content is suitable for the designated audience.
Content Warnings: Include disclaimers or content warnings for potentially distressing content, such as graphic violence or visually disturbing intense scenes.
4. Security and Data ProtectionSecure Platform: Use secure methods for uploading content and not upload viruses or malicious code or do anything that could disable, overburden, interfere with or impair the proper working of the Watcho platform.
You should not access, register or upload as proxy or use usernames or passwords not owned by you.
5. Advertising and ASCI CodeCompliance with Advertising Standards: Follow the guidelines set by the Advertising Standards Council of India (ASCI) for truthful and non-deceptive advertising. Disclose any sponsored content or advertisements clearly to the audience. Ensure that sponsored content is marked and does not mislead viewers.
Content creators must ensure that any promotional material they share includes a clear disclosure label identifying it as an advertisement. Additionally, the disclosure should be placed prominently and upfront to ensure it is easily noticed by the average consumer.
6. Quality StandardsTechnical Specifications: Ensure content meets the technical requirements of the Watcho platform, including video resolution, audio quality and file formats.
7. Content EditingReview content thoroughly for technical errors, inconsistencies, and quality issues before uploading.
